When Virginia seceded from the Union in April 1861, Unionist delegates from the northwestern counties reconvened as the Restored Government of Virginia and voted to form a separate state. The constitutional mechanism was contentious: Article IV of the US Constitution requires a state legislature's consent to divide it, which Congress resolved by recognizing the Restored Government as the legitimate Virginia legislature. West Virginia was admitted as the 35th state on June 20, 1863, the only state admitted to the Union during the Civil War.
